    ADVERTISEMENT

    FROM THE ÜRGÜP MUNICIPALITY

    1- SUBJECT: The closed parking lot and the list of open and closed parking lots, which are owned by our Municipality and located on Güllüce Street in the Cumhuriyet Neighborhood of our district, are put out to tender for a lease of 5 (Five) years, in accordance with Article 45 of the 2886 Law. The lease will be conducted through a tender process as specified below.

    2- LOCATION WHERE THE TENDER SPECIFICATIONS CAN BE OBTAINED:

    The tender specifications for the job to be tendered can be obtained from the Directorate of Writing Affairs at the Ürgüp Municipality Building during working hours until the day and hour of the tender.

    3- TENDER IMPLEMENTATION

    a) The tender decision will be approved or canceled by the responsible authority within a maximum of 15 working days from the date of the tender.

    b) The administration is free to decide whether to conduct the tender and to determine the appropriate amount.

    4- LOCATION, DATE, TIME, AND METHOD OF THE TENDER:

    The tender will be held on March 4, 2020, Wednesday at 11:00 at the Ürgüp Municipality Temporary Service Building, in the presence of the council, by open auction method.

    5- CONDITIONS FOR PARTICIPATING IN THE TENDER

    Bidders must submit the following documents with their offers in order to participate in the tender:

    a) Signature declaration or signature circular showing the authority to submit an offer;

    1) If the bidder is a natural person, a notarized signature declaration,

    2) If the bidder is a legal entity, a Trade Chamber registration certificate, and a copy of the Trade Registry Gazette showing the current status of the entity’s partners, members, or founders, and the persons assigned in the management. If not all information is in a single Trade Registry Gazette, additional documents or gazettes showing all the necessary information, along with the notarized signature circular of the legal entity.

    1. b) Temporary guarantee letter or proof of payment for the temporary guarantee or other guarantees deposited with the Treasury or Accounting Directorates, as specified in the special conditions of the tender specifications.
    2. c) The activity field of parking lot management should be indicated in the Trade Registry Gazette or tax plate.
    3. d) If participating in the tender by proxy, a notarized power of attorney and notarized signature declaration of the proxy.
    4. e) Additional guarantee letter or receipt as required by the administration for the parking lot automation system, as stated in the special conditions.
    5. f) Those with outstanding debts to our Municipality for water, real estate, CTV, participation share, etc., cannot participate in the tender.

    6- GUARANTEE

    Temporary Guarantee

    The estimated annual rental fee for the job to be tendered is 300,000.00 TL (Three Hundred Thousand Turkish Liras) including VAT, and the temporary guarantee calculated for 5 years based on the estimated value is 3% of the estimated amount, which is 45,000.00 TL (Forty-Five Thousand Turkish Liras). The bidder is required to submit the receipt or documents proving payment of the temporary guarantee and any additional guarantees specified in the special conditions in their offer envelope.

    Accepted Forms of Guarantee

    1. a) Turkish currency in circulation
    2. b) Guarantee letters issued by banks and participation banks
    3. c) State domestic debt securities issued by the Ministry of Finance, or documents issued in lieu of these securities (the face value of these securities and the documents issued in lieu of them will be accepted as guarantees based on their market value, including interest).
    4. d) If a guarantee letter is provided, it must comply with the principles determined by the Public Procurement Authority. Guarantees may be exchanged for other accepted forms of guarantee.

    7- PAYMENTS

    1. a) The rental start date is the date when the responsible authority approves the tender. The tenant must sign the lease agreement within 15 days after the tender is finalized, pay the annual rental fee, the 6% final guarantee calculated from the 5-year rental fee, 1.89% stamp tax, 5.69% tender decision tax, and the announcement fee.

    The tenant must also pay any additional obligations arising from changes in VAT regulations or new arrangements as per the applicable laws.

    1. b) Rent is paid annually in advance. The rent for the 2nd year and parking fees will be determined by the Municipality Council at the end of the 1st year. The rent and parking fees will be increased by the same rate. The tenant cannot object to this. If the tenant does not accept the determined rental fee, the lease agreement will be considered terminated without the need for a protest or judgment.
    2. c) If the tenant does not fulfill the conditions specified in the specifications or fails to sign the lease agreement in accordance with the specifications within the deadline, the tender will be canceled, and the temporary guarantees will be forfeited. These persons will be banned from participating in tenders for one year.
    3. d) The administration may add new parking spaces to the parking lease agreement or temporarily provide some of the specified locations for free. These additions or reductions will be added or subtracted proportionally based on the total number of parking spaces. The special conditions and file for this tender can be reviewed at the Municipality’s Writing Affairs Directorate during working hours, and the special conditions can be obtained for 150.00 TL.
