    ANNOUNCEMENT

    FROM ÜRGÜP MUNICIPALITY

    ARTICLE 1 - INFORMATION REGARDING THE ADMINISTRATION:
    1.1. The Administration’s:

    1.2. Bidders may obtain information regarding the auction by contacting the responsible personnel at the above address and phone number.

    ARTICLE 2 - INFORMATION REGARDING THE LEASING TASK SUBJECT TO THE AUCTION:
    2.1. The enclosed parking lot located at the lower part of Turgut Özal Business Center on Güllüce Street, Cumhuriyet Neighborhood, and the open parking spaces located in various areas of our district as indicated in the attached map, owned by our municipality, are put up for auction to be leased for a period of 3 years through an open bidding process in accordance with Article 45 of Law No. 2886 and the provisions of the special tender specifications.

    2.2. The estimated monthly rental fee for the business to be leased is 250,000.00 TL (including VAT). The temporary guarantee amount is 270,000.00 TL, which is 3% of the estimated value for 3 years. If the temporary guarantee is in cash, it shall be deposited at the municipality’s cashier or into the administration’s account. If provided as a guarantee letter, the guarantee letters shall be submitted to the administration.

    2.3. If the final guarantee is provided but the notarized contract is not signed within 15 days, the provided guarantee will be forfeited as revenue to the municipality.

    ARTICLE 3 - RENTAL FEE AND VAT PAYMENT METHOD:
    3.a. The 2024 rental fee shall be paid monthly in advance, including VAT.
    3.b. The monthly rental fees for the enclosed parking lot and open parking spaces for the years following the first year will be determined and collected by applying an annual increase based on the revaluation rate set by the Ministry of Finance.

    ARTICLE 4 - INFORMATION REGARDING THE AUCTION AND THE DEADLINE FOR SUBMISSION OF FINAL BIDS:
    4.1.
    a) Auction Method: Open bidding procedure pursuant to Article 45 of State Procurement Law No. 2886
    b) Address for Submission of Auction Participation Files: Ürgüp Municipality Registry Office, located at Cumhuriyet Mahallesi Atatürk Bulvarı No:40, ÜRGÜP
    c) Auction Location: Ürgüp Municipality Council Meeting Hall, located at Cumhuriyet Mahallesi Atatürk Bulvarı No:40, ÜRGÜP
    d) Auction Date/Time: 26.11.2024, Tuesday / 15:30
    e) Deadline for Submission of Auction Participation File: 11.2024 / 14:00

    4.2. Auction Participation Files must be submitted to our Registry Office by the date and time specified in Article 4.1.d of this Specification. Bidders who fail to submit their Auction Participation File will not be allowed to participate in the auction. Bidders whose submitted files are found, upon review, to not meet the conditions required by this Specification will also be excluded from participating in the auction.

    4.3. If the auction date falls on a public holiday, the auction will be held on the next business day at the location and time specified above.

    4.4. If working hours change after the announcement date, the auction will still take place at the time specified above.

    4.5. The national time setting of the Turkish Radio and Television Corporation (TRT) will be used as the standard for time adjustments.

    ARTICLE 5 - VIEWING AND OBTAINING THE AUCTION DOCUMENTATION:
    5.1. The auction documentation can be viewed free of charge at the address specified in Article 1.1 of this Specification. However, it is mandatory for those participating in the auction to purchase the auction documentation. The auction documentation can be purchased from the Ürgüp Municipality Registry Office at the address specified in Article 1.1. The cost of the auction documentation is 500.00 TL (Five Hundred Turkish Lira).

    5.2. Those wishing to purchase the auction documentation shall verify the authenticity and completeness of the documents constituting the auction documentation. After this review, any deficiencies noted must be reported to the Administration in writing. If no written objections regarding the matter are received by the Administration after the purchase of the auction documentation, the bidder will be deemed to have accepted the authenticity and completeness of the documents constituting the auction documentation.

    ARTICLE 6 - NOTIFICATION AND SERVICE PRINCIPLES:
    6.1. Notifications and services will be made via registered mail with return receipt or by hand with a signature. However, it is required that the bidder specifies an email address and/or fax number in the form confirming the purchase of the auction documentation and commits to accepting notifications sent to this email address or fax number. The Administration may also send notifications via email or fax.

    6.2. For notifications made by the Administration via email or fax, the notification date will be considered the service date. Such notifications must be confirmed by the Administration on the same day. Otherwise, the notification will be deemed not to have been made. For the confirmation to be considered complete, it is sufficient that the notification has been sent via registered mail with return receipt. Notifications made via email or fax will be further documented, including the notification date and content.

    6.3. Notifications and services to joint ventures by the Administration will be made to the lead/coordinator partner in accordance with the principles above.

    ARTICLE 7 - REQUIRED DOCUMENTS AND ELIGIBILITY CRITERIA FOR PARTICIPATION IN THE AUCTION:
    6.1. Bidders must submit the following documents to participate in the auction:
    Only real and legal persons who are citizens of the Republic of Turkey may participate in the auction. However, if the participant operates under an association:

    7.1.a) Document from the relevant trade and/or industry chamber or professional association as required by legislation:

    1. For real persons, a document obtained within the year of the initial announcement or auction date from the trade and/or industry chamber or artisans and craftsmen chamber where they are registered, proving their registration with the chamber,
    2. For legal entities, a document obtained within the year of the initial announcement or auction date from the trade and/or industry chamber where they are registered, proving the legal entity’s registration with the chamber,
    3. For associations or foundations, a board decision containing the necessary information for participation in the auction and a document proving the association/foundation is active.

    7.1.b) Notarized signature circular proving authority to submit a bid:

    1. For real persons, a photocopy of their identity card/passport and a notarized signature circular/declaration,
    2. For legal entities, the latest Trade Registry Gazette showing the partners, members, or founders of the legal entity and the officials managing it; if all this information is not in a single Trade Registry Gazette, all relevant Trade Registry Gazettes or documents verifying these details, along with the legal entity’s notarized signature circular.

    7.1.c) Document proving the submission/deposit of the temporary guarantee.
    7.1.d) If participating by proxy, a notarized power of attorney authorizing participation in the auction, along with the proxy’s notarized signature declaration.
    7.1.e) A document from Ürgüp Municipality proving no debts (property tax, environmental tax, rent, water, etc.), obtained on the date the auction participation file is submitted to our municipality.
    7.1.g) Document proving the purchase of the auction documentation.
    7.1.h) Residency certificate.
    7.1.i) Criminal record certificate.
    7.1.j) Documents from relevant institutions proving no debts to the Social Security Institution (SGK) or tax authorities.

    ARTICLE 8 - OPENNESS OF THE AUCTION TO FOREIGN BIDDERS:
    This auction is open only to domestic bidders.

    ARTICLE 9 - THOSE INELIGIBLE TO PARTICIPATE IN THE AUCTION:
    9.1. Individuals specified in Article 6 of Law No. 2886, those prohibited from participating in auctions under Article 11 of Law No. 4734, and bidders from foreign countries determined by Cabinet decisions under Article 53(b)(8) of Law No. 4734, whether directly, indirectly, or as subcontractors, on their own behalf or on behalf of others, cannot participate in the auction in any way.

    9.2. Bidders who participate despite these prohibitions will be excluded from the auction, and their temporary guarantees will be forfeited as revenue. Furthermore, if this situation is not detected during the bid evaluation phase and the auction is awarded to one of them, the guarantee will be forfeited as revenue, and the auction will be canceled.

    9.3. Participation in the auction as a joint venture or consortium of companies is not allowed.

    ARTICLE 10 - REJECTION OF ALL BIDS AND CANCELLATION OF THE AUCTION:
    The Auction Commission is free to decide whether or not to proceed with the auction and determine the appropriate price, provided it specifies the reason. The Auction Commission’s decision not to hold the auction is final.

    ARTICLE 11 - ACCEPTABLE GUARANTEE TYPES:
    11.1. The following are accepted as guarantees:

    • Circulating Turkish currency,
    • Guarantee letters (guarantee letters issued by banks and surety bonds issued under surety insurance by insurance companies established in Turkey),
    • Domestic Government Bonds issued by the Undersecretariat of Treasury and documents issued in lieu of such bonds. (For Domestic Government Bonds issued with interest added to the nominal value, the sales value corresponding to the principal will be accepted as a guarantee.)

    11.2. If a guarantee letter is provided, it must comply with the provisions of Article 27 of Law No. 2886.

    11.3. Guarantees may be exchanged with other acceptable guarantee types.

    11.4. Guarantees taken by the Administration, under any circumstances, cannot be seized or subject to precautionary measures.

    ARTICLE 12 - AUCTION EXPENSES:
    All taxes, duties, fees related to the auction, and notarization expenses for the lease contract, if applicable, will be borne by the contractor.

    In the event of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.

    The special specification file for this auction can be viewed at the Ürgüp Municipality Registry Office during working hours every day and can be purchased for a fee of 500.00 TL. This is hereby announced.
