    ANNOUNCEMENT

    FROM ÜRGÜP MUNICIPALITY

    1- SUBJECT OF THE WORK:

    This tender pertains to the collection, transportation, separation, and evaluation of all packaging waste within the municipal boundaries of Ürgüp District, under the coordination of the Ürgüp Municipality Public Works Directorate. The work involves collecting packaging waste separately from other waste at the point of generation, as per the Packaging Waste Control Regulation dated June 26, 2021, numbered 31523, and the Zero Waste Regulation dated July 12, 2019, numbered 30829. The task will be carried out by a Packaging Waste Collection and Separation company holding a temporary activity certificate and/or an environmental license. The service is put out to tender for a 3-year lease in accordance with Article 45 of Law No. 2886.

    2- TENDER LOCATION, DATE, AND METHOD:

    Time: 16:30

    Method: The tender will be conducted through an open auction as per Article 45 of the Tender Law No. 2886 at the specified location and time.

    3- CONDITIONS FOR PARTICIPATION IN THE TENDER:

    The following information and documents are required from participants wishing to join the tender.

    1. a) Being a citizen of the Republic of Turkey,
    2. b) Declaration of a correspondence address for notification, phone and fax numbers, and a photocopy of the identity card; for legal entities, a Chamber of Commerce certificate, signature circular, and authorization certificate,
    3. c) A document proving no debts to our municipality,
    4. d) A document proving the deposit of the temporary guarantee and proof of purchase of the administrative and technical specifications,
    5. e) A Packaging Waste Collection and Separation License from the Ministry of Environment, Urbanization, and Climate Change for the company participating in the tender,
    6. f) A reference document from any public institution or organization proving that the licensed company has performed this work,

    reference document, g) Documents from relevant institutions proving no debts to the Social Security Institution (SGK) or tax authorities,

    4- THOSE WHO CANNOT PARTICIPATE IN THE TENDER:

    1. a) Persons specified in Article 6 of Law No. 2886,
    2. b) Those who previously won a tender with Ürgüp Municipality but did not sign a contract or failed to fulfill their obligations, resulting in the termination of the tender,

    despite having won it, did not sign a contract or failed to fulfill their obligations, leading to the tender’s cancellation.

    1. c) Those banned from tenders by any public institution or municipality for any reason,

    ç) If individuals or companies in the above situations knowingly or unknowingly participate in the tender and win it, the tender will be canceled, and their temporary guarantees, as well as any deposited final guarantees, will be recorded as revenue. No contract will be signed with them. If a contract has been signed, it will be unilaterally terminated without prior notice.

    1. d) Participants must submit a criminal record certificate obtained from the Public Prosecutor’s Office within the tender month. Those with a criminal record, except for negligent offenses, cannot participate in the tender.

    5- SUBMISSION LOCATION AND DATE OF DOCUMENTS:

    The information and documents specified in Article 3 of the specifications must be submitted to the Ürgüp Municipality Correspondence Directorate by 14:00 on July 9, 2024. For applications made by mail, the municipality will not be responsible for delays caused by postal services.

    6- ESTIMATED PRICE AND GUARANTEES

    1. a) The annual rental fee for the separation work, excluding VAT, is 60,000.00 TL, with a temporary guarantee of

    64,800.00 TL.

    1. b) To participate in the tender, bidders must meet the qualifications specified in Law No. 2886, submit bids as outlined in the law, and deposit the temporary guarantee.

    Tender decisions made by the tender commissions will be approved or canceled by the authorizing officers within 15 business days from the decision date. If the decision is canceled by the authorizing officer, the tender will be deemed void.

    Approved tender decisions will be notified to the tenant or their representative within 15 business days from the approval date, either by obtaining their signature or by sending a registered letter to the notification address. The 7th day following the mailing of the letter will be considered the notification date to the tenant or their representative.

    Within 15 days of the notification of the approved tender decision under Articles 31 or 76 of the State Tender Law No. 2886, the tenant must deposit the final guarantee, sign the contract, and pay the tender-related and rental taxes, fees, duties, and other expenses. Failure to comply with these obligations will result in the cancellation of the tender without the need for protest or judgment, and the temporary guarantee will be recorded as revenue by the municipality.

    7- PAYMENT METHOD OF THE RENTAL FEE

    The rental fees for the collection, separation, and evaluation of packaging waste will commence following the signing of the contract, with the first year’s rental fee paid annually in advance and subsequent years paid monthly in advance. In case of delay (non-payment), the rental fees will be collected with a daily late payment penalty determined under Article 51 of Law No. 6183, and the tender will be unilaterally terminated.

    For the years following the first year, the rental fees for the collection, separation, and evaluation of packaging waste will be determined and collected with an increase based on the revaluation rate set by the Ministry of Finance each year.

    - All legal expenses such as advertisements, taxes, fees, duties, and notarized rental agreements related to this tender will be borne by the tenant.

    - The tender commission is free to decide whether to proceed with the tender, stating its reasons in the decision.

    No objections can be raised against the commission’s decision not to proceed with the tender.

    - In case of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.

    It is hereby announced that the special tender specification file can be viewed at the Municipal Correspondence Directorate during working hours every day and purchased for 500.00 TL. June 11, 2024
