FROM THE ÜRGÜP MUNICIPALITY

Subject of the tender: The Cafeteria Restaurant and Parking Lot, which is owned by our municipality, has been tendered for lease for 10 years in accordance with the decision of the Municipal Council dated 06.03.2020, with decision number 2020/11, and Article 45 of the Law No. 2886, including the special conditions, through an open auction.

1- Tender place and time: The tender will be held at 10:30 AM on Wednesday, May 6, 2020 in the presence of the Council at our Municipality.

The tender will take place in the municipality.

Conditions for participation in the tender, required documents, and approval:

2- The temporary security deposit for the Cafeteria, Restaurant, and Parking Lot, as specified below, must be deposited to our municipality before the tender time (no later than 10:15).

3- The annual rent for the Cafeteria Restaurant and Parking Lot will be paid in advance. The payments must be made within 15 days from the tender date, and the premises will be handed over upon payment. If the annual rent is not paid, the tender will be unilaterally canceled.

4- Any firm, company, or cooperative participating in the tender must present their Chamber of Commerce Registration Certificate, Commercial Registry Certificate, Signature Circular, and Authorization Letter (notarized). Additionally, all company partners must give personal power of attorney to the authorized person or sign the contract prepared by all the partners.

5- Participants in the tender must present a criminal record from the Public Prosecutor's Office within the tender month. Those who have been convicted of any criminal offenses (except negligent crimes) cannot participate in the tender.

6- Those who wish to participate in the tender must present a document from the relevant chamber showing that they have been operating a Restaurant or Cafeteria for at least 5 years. This document could be a trade registry newspaper, certified document from the Chamber of Commerce or Chamber of Tradesmen and Artisans. They must also present documents proving that they have no debts to the SGK and the Tax Department on the day they participate in the tender. Those who cannot present these documents will not be able to participate in the tender.

7- Participants in the tender must submit a receipt or letter of guarantee (the guarantee letter cannot be valid for less than 9 months) showing that they have deposited an additional guarantee of 500,000.00 TL at the municipal cashier along with the documents they will submit to the tender commission.

The 500,000.00 TL guarantee will be refunded to the lessee after the temporary acceptance of the work done at the Cafeteria, Restaurant, and Parking Lot, which will be evaluated by our Municipality's Department of Public Works. If the lease agreement is not signed or the specified work is not completed on time, the 500,000.00 TL guarantee will be forfeited by our municipality. The work performed by the lessee in the Cafeteria Restaurant and Parking Lot, excluding furnishings (including air conditioning and natural gas boilers), will be left to our municipality free of charge at the end of the lease period. Even if not specified in the list of required works, any necessary work for the integrity of the project must be completed. If the 6-month period given for the work is insufficient, an additional 1-month extension may be granted, and if the work is not completed, the tender will be unilaterally canceled.

8- All legal expenses such as advertisements, taxes, duties, and fees related to this tender will be borne by the lessee.

9- The tender commission is free to decide whether or not to conduct the tender, and its decision can be justified in writing. No appeal can be made to the commission's decision not to conduct the tender.

10- In case of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.
