    URBAN PASSENGER TRANSPORTATION LINES RENTAL ANNOUNCEMENT

    ANNOUNCEMENT

    FROM ÜRGÜP MUNICIPALITY

    The urban passenger transportation lines within our district, as determined by our municipality and specified below, along with the Central Station Drivers' Waiting Office, have been put out to tender for a 5-year lease in accordance with the decision of our Municipal Council dated July 3, 2024, numbered 2024/72, pursuant to Article 15/p of Law No. 5393 and Article 45 of Law No. 2886.

    1- The tender will be held on Tuesday, September 10, 2024, at 15:30 in the presence of the Municipal Council at our municipality.

    2- TENDER METHOD AND ELIGIBILITY CONDITIONS:
    a) The tender will be conducted by the Ürgüp Municipal Council.
    b) Ürgüp Municipality is subject to the provisions of the State Tender Law No. 2886.
    c) The Tender Commission is free to decide whether to proceed with the tender.
    d) Only companies or cooperatives (legal entities) may participate in the tender. Partners of the participating companies or cooperatives must submit a criminal record certificate from the Public Prosecutor’s Office within the tender month. Those with a criminal record (except for negligent offenses) cannot participate in the tender.
    e) Companies and cooperatives participating in the tender must have no debts to our municipality, the Ministry of Finance, or the Social Security Institution (SGK). Those with debts to these institutions cannot participate.
    f) For urban passenger transportation in Ürgüp, a minimum of 19 vehicles will be used for public transportation purposes, with the number of vehicles increasing to 25 within one year. One electric minibus must be procured and put into service by December 31, 2024. The electric vehicle to be procured will have a capacity of 12 passengers.
    The companies or cooperatives participating in the tender must submit documents proving that the public transportation vehicles specified in the general provisions and technical specifications below are registered under their name on the tender day. If they cannot submit vehicle documents on the tender day, they must provide a notarized commitment to our municipality stating they will procure 19 vehicles within 10 days from the tender date, along with an additional guarantee of 100,000.00 TL per vehicle, totaling 1,900,000.00 TL, in the form of a bank guarantee letter or cash. Failure to fulfill this obligation will result in unilateral termination of the tender, and both the temporary guarantee and additional guarantee will be recorded as revenue.
    g) For operators continuing the Ürgüp Urban Public Transportation service, the vehicles submitted to our municipality must have a minimum model year of 2012 (maximum 12 years old). Vehicles older than 12 years will not be accepted for public transportation, and no transportation permit will be granted. Low-model vehicles must be upgraded to an appropriate model within 6 months.
    ğ) The temporary guarantee for the tender, calculated over 5 years, is 144,000.00 TL. Additionally, an extra guarantee for 19 vehicles (100,000.00 TL per missing vehicle, totaling 1,900,000.00 TL) must be provided by 14:00 on the tender day, either in cash or as a bank guarantee letter. Failure to deposit the guarantees or comply with the special specifications, or failure to procure the vehicles and start operations within the specified period, will result in unilateral termination of the tender, and both the temporary and additional guarantees will be recorded as revenue by our municipality.
    h) Trade Chamber Registration Certificate, Trade Gazette, and a document from 2024 proving that the company, cooperative, or other legal entity is registered and still operational, along with a tax registration certificate (originals or notarized copies), must be submitted.
    ı) Individuals participating on behalf of a company, cooperative, or any legal entity must submit an authorization certificate and signature circular (original or notarized copy) proving their authority to participate in the tender. If the authorized person does not participate, the person attending must submit a notarized power of attorney.

    3- BIDDING AND TENDER PROCEDURE:
    a) Bidders must submit the required documents, temporary guarantee, additional guarantee, and proof of purchase of the special specifications to the Ürgüp Municipality Correspondence Directorate by no later than 14:00 before the tender time.
    b) Participation by mail is possible provided the conditions are met. However, if the bid exceeds the amount stated in the offer letter during the open auction, the offer letter becomes invalid, and the guarantee is refunded. Offer letters must reach the Ürgüp Municipality Correspondence Directorate before the tender time. Postal delays will not be accepted.
    c) The winning bidder must sign each page of the tender specifications in the presence of the tender commission, confirming they have read and fully accepted the terms.
    d) The tender will be conducted through an open auction among bidders who have fully submitted the required documents and temporary guarantee letter, in the presence of the Council. Those who do not deposit the temporary guarantee or fail to submit any required document cannot participate.

    4- GUARANTEE
    A) Temporary Guarantee
    The operator must deposit the temporary guarantee (144,000.00 TL) and an additional guarantee for 19 vehicles (100,000.00 TL per missing vehicle, totaling 1,900,000.00 TL) in the form of a bank guarantee letter (or cash) in accordance with the values specified in Article 26 of Law No. 2886.

    B) Accepted Guarantee Values:
    a) Turkish Lira,
    b) Unlimited and definitive guarantee letters in Turkish Lira issued by banks specified by the Ministry of Finance,
    c) Government bonds and bonds guaranteed by the Treasury,
    d) If the winning legal entity withdraws from the contract, the tender will be unilaterally terminated, and both the temporary and additional guarantees (cash or bank guarantee letter) will be recorded as revenue by our municipality.

    5- VEHICLE REQUIREMENTS
    A) General Provisions
    a) Vehicles must be manufactured in accordance with the technical specifications for the construction, modification, and assembly of urban vehicles as stipulated in the Republic of Turkey Highway Traffic Law No. 2918, its regulations, and other relevant legislation, and comply with the 2001/85/EC regulations. They must be equipped with the equipment required by the Highway Traffic Law.
    b) Vehicles must comply with the Highway Traffic Law No. 2918 and its regulations.
    c) Vehicles must have valid liability insurance and technical inspections in accordance with the law, and each vehicle must obtain urban passenger transportation permits as required by the Highway Traffic Law and regulations.

    B) Passenger Capacity:
    Vehicles will have a standard capacity of 14 passengers. Additional vehicles will be provided if the passenger count exceeds this during a trip.
    a) Passenger capacity will be a standard 14 persons.
    b) There must be a designated space and seatbelt system for wheelchair users. The wheelchair area will have 2 foldable seats.

    C) Security and Surveillance Camera System
    Vehicles will be equipped with 4 cameras, including 2 with audio recording, capable of real-time monitoring and storing recordings for at least 30 days, as per the route map provided by the municipality.
    a) Camera-1: Will show the driver’s upper body and the entrance door, with audio recording.
    b) Camera-2: Will show the road through the front windshield, without audio recording.
    c) Camera-3: Will show the corridor from the rear to the front, with audio recording.
    d) Camera-4: Will show the road behind through the rear window, without audio recording.
    e) Each vehicle will have a visible sign stating, “This vehicle is equipped with 24-hour audio and video recording.”

    D) Passenger Fee Collection
    a) Passenger fees will be collected via a card payment system once the administration completes its preparations.
    b) Until the card system is implemented, fees may be collected in cash.

    6- All legal expenses such as advertisements, taxes, fees, duties, and notarized rental agreements related to this tender will be borne by the tenant.

    7- The tender commission is free to decide whether to proceed with the tender, stating its reasons in the decision. No objections can be raised against the commission’s decision not to proceed with the tender.

    8- In case of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.

    It is hereby announced that the special tender specification file can be viewed at the Municipal Correspondence Directorate during working hours every day and purchased for 1,500.00 TL. August 13, 2024
