ANNOUNCEMENT

FROM ÜRGÜP MUNICIPALITY

ARTICLE 1) SUBJECT AND SCOPE OF THE AUCTION:
The property and ticket booth spaces, owned by our municipality, located in Cumhuriyet Neighborhood and Cumhuriyet Square, with their location, type, plot, block, parcel numbers, square footage, estimated monthly rental fees, and temporary guarantees specified below, are put up for auction to be leased for a period of 1 year through an open bidding process in accordance with Article 45 of Law No. 2886 and the provisions of the special tender specifications.

ARTICLE 2) AUCTION LOCATION, DATE, AND TIME:

• Auction Location: The auction will be held in the Ürgüp Municipality Council Hall in the presence of the Municipal Committee.
• Auction Date: 22.10.2024
• Auction Time: Starting at 15:30 with 10-minute intervals between each item
• Auction Method: Open bidding procedure pursuant to Article 45 of State Procurement Law No. 2886

ARTICLE 3) CONDITIONS FOR PARTICIPATION IN THE AUCTION:
Participants in the auction are required to provide the following information and documents:
a) Be a citizen of the Republic of Turkey,
b) Declaration of an address for notifications, along with a contact phone number and, if available, a fax number and email address,
c) For legal entities, a document proving registration with the Chamber of Commerce and Industry where the entity is registered or a document from the location of its headquarters confirming its legal entity status,
d) In the case of a joint venture, each real or legal person forming the joint venture must separately provide the documents required under items (a) and (b),
e) For legal entities participating in the auction, a notarized signature circular,
f) For those participating by proxy, a notarized power of attorney, their signature circular, and the notarized signature circular of the principal bidder,
g) A receipt proving the purchase of the auction specifications,
h) Documents obtained no more than 15 days prior to the auction date proving no debts to the Social Security Institution (SGK) or tax authorities,
i) Criminal record certificate

ARTICLE 4) THOSE INELIGIBLE TO PARTICIPATE IN THE AUCTION:
a) Individuals specified in paragraphs (a), (b), and (c) of the first paragraph of Article 6 of Law No. 2886, as well as those permanently or temporarily barred from participating in public auctions under this law or other laws, cannot participate in the auction. If such individuals participate and win the auction in violation of this prohibition, their auction will be canceled, and their deposited guarantee will be forfeited as revenue.
b) Those who have not deposited the temporary guarantee and real or legal persons with debts to our municipality (such as water, property tax, environmental tax, official fees, rental fees, etc.), as well as partners, directors, or board members of such legal entities and other legal entities in which they hold similar positions, cannot participate in the auction unless they provide a document from our municipality’s Financial Services Directorate proving that their debts have been paid. Even if they participate and win the auction, it will be canceled.
c) Participants must submit a criminal record certificate obtained from the Public Prosecutor’s Office within the auction month. Those with a criminal record (except for offenses committed through negligence) cannot participate in the auction.

ARTICLE 5) ESTIMATED VALUE, TEMPORARY GUARANTEE, AND RENTAL PAYMENTS:
The rental fees for the property and ticket booths will commence following the approval of the auction. Rental fees must be paid monthly in advance. If the rental fee is not paid for two consecutive months, the auction will be unilaterally terminated by our municipality, and the temporary guarantee will be forfeited as revenue.

The rental fees for the property and ticket booths for the years following the first year will be determined and collected by applying an annual increase based on the revaluation rate set by the Ministry of Finance.

Those wishing to deposit the temporary guarantee in cash instead of a bank guarantee letter must deposit the amounts specified below at the municipality’s cashier no later than 12:00 on the auction day.

Those who do not deposit the temporary guarantees specified below or who have debts to our municipality (such as water, property tax, environmental tax, etc.) cannot participate in the auction.

ARTICLE 6) IMPLEMENTATION OF THE TASK:

1. Only those holding a D4, D1, or F1 certificate under the Road Transport Regulation may participate in the auction for the ticket booth spaces to be leased.
2. For the ticket booth spaces to be leased, each certificate holder may participate in the auction for only one booth, and leasing solely for F1 agency operations will not be permitted.
3. Those leasing the ticket booth spaces must operate the specified business during the lease term, and the booth space may not be used for any other purpose. The ticket booth may only sell tickets of the company on whose behalf the bidder participates in the auction. For selling tickets of other companies, an F1 certificate is mandatory.

• All legal expenses related to this auction, such as announcements, advertisements, taxes, duties, fees, and notarization of the lease contract, will be borne by the lessee.
• The auction commission is free to decide whether or not to proceed with the auction, provided it specifies the reason in its decision. The commission’s decision not to hold the auction cannot be contested.
• In matters not covered by this specification, the provisions of State Procurement Law No. 2886 will apply.

ARTICLE 6) RESOLUTION OF DISPUTES:
In the event of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction. The special specification file for this auction can be viewed at the Ürgüp Municipality Registry Office during working hours every day and can be purchased for a fee of 500.00 TL.
