Packaging Waste Collection - Negotiation Auction Announcement

ANNOUNCEMENT

FROM ÜRGÜP MUNICIPALITY

The task of collecting, separating, and evaluating packaging waste was put up for auction to be leased through an open bidding process in accordance with Article 45 of Law No. 2886 and the provisions of the special tender specifications. Since no bidders participated in the auction, the task of collecting, separating, and evaluating packaging waste has been opened for negotiation for a period of 15 days starting from 26.11.2024, pursuant to Article 49 of Law No. 2886. Details regarding the task are provided below.

1- SUBJECT OF THE TASK:
This auction pertains to the collection, transportation, separation, and evaluation of all packaging waste, to be carried out separately from other waste at the point of origin, within the municipal boundaries of Ürgüp District under the coordination of the Ürgüp Municipality Public Works Directorate. The task will be performed by a Packaging Waste Collection and Separation company holding a temporary activity certificate and/or an environmental license, and it is put up for auction to be leased for a period of 3 years in accordance with Article 45 of Law No. 2886, pursuant to the Packaging Waste Control Regulation dated 26.06.2021 (No. 31523) and the Zero Waste Regulation dated 12.07.2019 (No. 30829).

2- CONDITIONS FOR PARTICIPATION IN THE AUCTION:
Participants in the auction are required to provide the following information and documents:
a) Be a citizen of the Republic of Turkey,
b) Mailing address for notifications, phone and fax numbers, a photocopy of the identity card; for legal entities, a Chamber of Commerce certificate, signature circular, and authorization document,
c) A document proving no debts to our municipality,
d) Criminal record certificate,
e) A document proving the deposit of the temporary guarantee and a document proving the purchase of the administrative and technical specifications,
f) Documents obtained from relevant institutions proving no debts to the Social Security Institution (SSK) or tax authorities.

3- THOSE INELIGIBLE TO PARTICIPATE IN THE AUCTION:
a) Individuals specified in Article 6 of Law No. 2886,
b) Those who previously won an auction held by Ürgüp Municipality but failed to sign a contract or failed to fulfill their obligations, resulting in the termination of the auction,
c) Those banned from participating in auctions for any reason by public institutions, organizations, or municipalities.

d) If individuals or companies associated with them, knowingly or unknowingly, participate in the auction and win it despite being in the aforementioned situations, the auction will be canceled, their temporary guarantee will be forfeited as revenue, and if a final guarantee has been deposited, it will also be forfeited. No contract will be signed with them. If a contract has been signed, it will be unilaterally terminated without prior notice.

e) Participants must submit a criminal record certificate obtained from the Public Prosecutor’s Office within the auction month. Those with a criminal record (except for offenses committed through negligence) cannot participate in the auction.

4- SUBMISSION LOCATION AND DATE OF DOCUMENTS:
The information and documents specified in Article 3 of the specifications must be submitted to the Ürgüp Municipality Registry Office by 12:00 on 26.11.2024. The municipality will not be responsible for delays caused by postal submissions.

5- ESTIMATED VALUE AND GUARANTEES:
a) The monthly rental fee for the separation task is 2,000.00 TL (excluding VAT), with a temporary guarantee of 2,160.00 TL.
b) To participate in the auction, participants must meet the qualifications specified in Law No. 2886, submit bids as outlined in the same law, and deposit the temporary guarantee.

Auction decisions made by the auction commissions will be approved or canceled by the authorizing officers within a maximum of 15 business days from the decision date. If the decision is canceled by the authorizing officer, the auction will be deemed void.

Approved auction decisions will be notified to the lessee or their representative with a signature, or sent via registered mail to the notification address, within a maximum of 15 business days from the approval date. The 7th day following the mailing of the letter will be considered the notification date to the lessee or their representative.

Within 15 days of the notification of the auction decision approved under Articles 31 or 76 of State Procurement Law No. 2886, the lessee must deposit the final guarantee, sign the contract, and pay the taxes, duties, fees, and other expenses related to the auction and lease. Failure to comply with these obligations will result in the cancellation of the auction without the need for protest or judgment, and the temporary guarantee will be forfeited as revenue to the municipality.

6- PAYMENT METHOD OF THE RENTAL FEE:
The rental fees for the task of collecting, separating, and evaluating packaging waste will be paid monthly in advance following the signing of the contract. In case of delay (non-payment), the rental fees will be collected with a daily late payment penalty determined under Article 51 of Law No. 6183, and the auction will be unilaterally terminated.

The rental fees for the task of collecting, separating, and evaluating packaging waste for the years following the first year will be determined and collected by applying an annual increase based on the revaluation rate set by the Ministry of Finance.

If the rental fee is not paid for two consecutive months, the contract will be terminated by the administration.

• All legal expenses, such as announcements, advertisements, taxes, duties, fees, and notarization of the lease contract related to this auction, will be borne by the lessee.
• The auction commission is free to decide whether or not to proceed with the auction, provided it specifies the reason in its decision. The commission’s decision not to hold the auction cannot be contested.
• In the event of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.
