    HOSPITAL FRONT - KIOSK RENTAL TENDER ANNOUNCEMENT

    ANNOUNCEMENT

    FROM ÜRGÜP MUNICIPALITY

    ARTICLE-1) SUBJECT AND QUANTITY OF THE TENDER:

    The immovable property, owned by our municipality and located in front of the hospital in 15 Temmuz Neighborhood of our district, with its type, square footage, estimated rental fee, and temporary guarantee specified below, has been put up for a 3-year lease through an open auction in accordance with Article 45 of Law No. 2886 and the provisions of the special specifications.

    ARTICLE-2) TENDER LOCATION, DATE, AND TIME

    Tender Location: The tender will be held in the Ürgüp Municipality Council Hall in the presence of the Municipal Council.

    Tender Date: July 23, 2024

    Tender Time: 15:30

    Tender Method: Open auction method pursuant to Article 45 of the State Tender Law No. 2886

    ARTICLE-3) CONDITIONS FOR PARTICIPATION IN THE TENDER:

    The following information and documents are required from participants wishing to join the tender:

    • a- Being a citizen of the Republic of Turkey,
    • b- Declaration of an address for notification, along with a phone number and, if available, a fax number and email address.
    • c- In the case of a legal entity, a document proving that the legal entity is registered, obtained from the Chamber of Commerce and Industry where it is registered or from the place where its administrative center is located.
    • d- If the participants form a joint venture, each real and legal person forming the joint venture must separately provide the documents specified in items (a) and (b).
    • e- For legal entities participating in the tender, a notarized signature circular.
    • f- For those participating by proxy, a notarized power of attorney, signature circular, and the notarized signature circular of the principal bidder.
    • g- A receipt proving the purchase of the tender specifications,
    • h- A document proving no debts to the Social Security Institution (SGK) or tax authorities, obtained no more than 15 days before the tender date.
    • i- Criminal Record Certificate

    ARTICLE-4) THOSE WHO CANNOT PARTICIPATE IN THE TENDER:

    • a- Persons specified in paragraphs a, b, and c of the first paragraph of Article 6 of Law No. 2886, as well as those banned temporarily or permanently from participating in public tenders under this law or other laws, cannot participate in the tender. If such persons participate and win the tender despite the prohibition, their tender will be canceled, and their deposited guarantee will be recorded as revenue.
    • b- Those who do not deposit the temporary guarantee and real or legal persons, including partners, managers, and board members of legal entities, who have debts to our municipality such as water, property tax, environmental tax, other taxes, official fees, or rental fees, cannot participate in the tender unless they provide a document from the Municipal Financial Services Directorate proving they have paid their debts. Even if they participate and win the tender, it will be canceled.
    • c- Participants must submit a criminal record certificate obtained from the Public Prosecutor’s Office within the tender month. Those with a criminal record, except for negligent offenses, cannot participate in the tender.

    ARTICLE-5) ESTIMATED PRICE AND RENT PAYMENTS:

    The estimated monthly rental fee for the immovable property, excluding VAT, is 10,000.00 TL, and the rental fee will commence following the approval of the tender. Rental fees will be paid annually in advance for the first year and monthly in advance for subsequent years. In case of delay (non-payment), the rental fees will be collected with a daily late payment penalty determined under Article 51 of Law No. 6183, and the tender will be unilaterally terminated.

    For the years following the first year, the rental fees for the immovable property will be determined and collected with an increase based on the revaluation rate set by the Ministry of Finance each year.

    ARTICLE-6) TEMPORARY GUARANTEE:

    Those wishing to deposit the temporary guarantee in cash instead of a bank guarantee letter must deposit it at the municipal cashier by no later than 14:00 before the tender time. The temporary guarantee for the property, calculated over 3 years, is 10,800.00 TL. Those who do not deposit the temporary guarantee or who have debts to our municipality such as water, property tax, environmental tax, etc., cannot participate in the tender.

    • All legal expenses such as advertisements, taxes, fees, duties, and notarized rental agreements related to this tender will be borne by the tenant.
    • The tender commission is free to decide whether to proceed with the tender, stating its reasons in the decision. No objections can be raised against the commission’s decision not to proceed with the tender.
    • In case of any dispute, the Ürgüp Courts and Enforcement Offices will have jurisdiction.

    It is hereby announced that the special tender specification file can be viewed at the Municipal Correspondence Directorate during working hours every day and purchased for 500.00 TL. July 2, 2024
