ANNOUNCEMENT FROM ÜRGÜP MUNICIPALITY
ARTICLE-1) SUBJECT AND QUANTITY OF THE TENDER:
The tender pertains to the leasing for 10 years of 40 double-sided racket billboards and 36 billboards located at bus stops and medians in various locations within our district, owned by our municipality, as well as 1 additional Gainboard (triple billboard), 1 Megaboard, 100 90x200 Pollbanner advertising spaces, 1 vehicle with technical specifications outlined in the attached list, and 1 vehicle-mounted mobile LED screen and stage. This is in accordance with the Ürgüp Municipal Council decision dated December 2, 2022, numbered 2022/55, under Article 45 of Law No. 2886 and the provisions of the special conditions, through an open auction procedure.
ARTICLE-2) TENDER LOCATION, DATE, AND TIME
Tender Location: Ürgüp Municipality Council Hall, in the presence of the Municipal Committee

Tender Procedure: Open Auction in accordance with Article 45 of the State Procurement Law No. 2886
ARTICLE-3) CONDITIONS FOR PARTICIPATION IN THE TENDER:
The following information and documents are required from participants:
a) A document showing the bidder’s residential address (Address Declaration)
b) Address declaration for notification purposes; additionally, a contact phone number and, if available, fax number and email address.
c) For individuals, a certified tax registration document from the tax office and a certified document proving registration with the Chamber of Commerce and Industry or the Chamber of Tradesmen and Craftsmen.
d) For legal entities, a document proving the legal entity’s registration, obtained from the Chamber of Commerce and Industry where it is registered or from the location of its administrative center.
e) In the case of a joint venture, each real or legal person forming the joint venture must separately provide the documents specified in items (a) and (b).
f) For legal entities, a notarized signature circular.
g) For those participating by proxy, a notarized power of attorney, signature circular, and the notarized signature circular of the principal bidder.
h) Receipt proving the purchase of the tender specifications.
i) A document obtained no more than 15 days prior to the tender date, certifying no outstanding debts to the Social Security Institution (SGK) or tax authorities.
ARTICLE-4) THOSE INELIGIBLE TO PARTICIPATE IN THE TENDER:
a) Individuals specified in paragraphs (a), (b), and (c) of Article 6, Paragraph 1 of Law No. 2886, as well as those permanently banned from public tenders under this law or other laws, cannot participate in the tender. If such individuals participate and win the tender despite the prohibition, the tender will be canceled, and their deposited guarantee will be recorded as revenue.
b) Real or legal persons with debts to our municipality (e.g., taxes, fees, rental fees) and partners, directors, or board members of such legal entities, as well as other legal entities where these individuals serve as partners, directors, or board members, cannot participate in the tender unless they provide a document from the Municipality’s Revenue Directorate, Accounting Directorate, Urban Planning Directorate, or Water Affairs Directorate proving payment of their debts. Even if they participate and win, the tender will be canceled.
ARTICLE-5) ESTIMATED VALUE AND RENTAL PAYMENTS:
The estimated monthly rental fee, including VAT, is 10,000.00 TL, and the rental payments will commence following the approval of the tender. Rental fees will be paid monthly in advance (on the first working day of each month). In case of delay (non-payment), the rental fees will be collected with a daily late payment penalty as determined under Article 51 of Law No. 6183, and the tender will be unilaterally terminated.
For the subsequent years after the first year, the rental fees for the 40 double-sided racket billboards, 36 billboards, 1 Gainboard (triple billboard), 1 Megaboard, 100 90x200 Pollbanner advertising spaces, 1 vehicle with technical specifications outlined in the attached list, and 1 vehicle-mounted mobile LED screen and stage will be increased annually based on the revaluation rate determined by the Ministry of Finance and will be assessed and collected accordingly.
Taxes for advertisements and announcements placed on the 40 double-sided racket billboards, 36 billboards, 1 Gainboard (triple billboard), 1 Megaboard, 100 90x200 Pollbanner advertising spaces, 1 vehicle, and 1 vehicle-mounted mobile LED screen and stage will be paid in advance to the municipal cashier before placement, based on the tariff set annually by the Municipal Council.
ARTICLE-6) TEMPORARY DEPOSIT:
Those wishing to pay the temporary deposit in cash instead of a bank guarantee letter must deposit it at the municipal cashier before the tender time (no later than 14:00). The temporary deposit for the subject work is 36,000.00 TL for 10 years. Those who do not deposit the guarantee and those with debts to our municipality (e.g., water, property tax, environmental tax) cannot participate in the tender.
ARTICLE-7) MUNICIPALITY’S USAGE RIGHTS:
The real or legal person winning the tender cannot transfer the usage rights of the 40 double-sided racket billboards, 36 billboards, 1 Gainboard (triple billboard), 1 Megaboard, 100 90x200 Pollbanner advertising spaces, 1 vehicle with technical specifications outlined in the attached list, and 1 vehicle-mounted mobile LED screen and stage to another party without the municipality’s permission.
All legal expenses related to this tender, including announcements, advertisements, taxes, duties, fees, and notarized rental agreements, will be borne by the tenant.
The tender commission is free to decide whether or not to proceed with the tender, provided the reason is stated in the decision. The commission’s decision not to hold the tender cannot be appealed.
In matters not specified in these conditions, the provisions of the State Procurement Law No. 2886 will apply.
ARTICLE-8) WORK EXPERIENCE:
Participants in the tender must provide documents proving they have conducted advertising work or operated such a business.
ARTICLE-9) DISPUTE RESOLUTION:
In case of any dispute, the Ürgüp Courts and Enforcement Offices shall have jurisdiction.
The special condition file related to this tender can be viewed at our municipality’s Registry Office during working hours every day and can be purchased for 250.00 TL, as hereby announced. January 18, 2023
